"Vertical? Flying Machine, Save" "Docket 168 -- Gerhardt & Brock Interference # 65,127, 65,128, 65,129, 62,662", 1931-1933

 File — Multiple Containers

Scope and Contents

File containing correspondence between the U.S. Patent Office and parties involved in an “Interference” declared by the Commissioner of Patents on November 6, 1931. The Interference process was intended to resolve conflicting claims in patent applications and determine “who is the true and original inventor.” This Interference, docketed as No. 62,662 (also 65,127, 65,128, 65,129 filed subsequently) involved application 413,747 for “Aerodynamic Instruction & Testing Methods & Apparatus for the Practice Thereof” filed December 13, 1929, by William F. Gerhardt and Clarence A. Brock of the Curtiss-Wright Flying Service at Grosse Ile Airport in Detroit, Michigan and applications filed by Ellis G. Holst, Theodore M. Pardue with John L. Pardue, and Joseph Weisinger. The file contains correspondence within the Curtiss-Wright Corporation, sworn statements of applicants, stipulations, motions, concessions of priority, license agreements, Examiner of Interferences decisions, drawings and sketches, printed patents, and some photographs of models used for flight training. Gerhardt claims in a memo to W.E. Valk (a lawyer in the Curtiss-Wright Corporation Patent Department) dated November 14, 1931, that “the idea for applying the external controls to an airplane model for demonstration and study purposes was conceived about May, 1929.” This interference was settled with license agreements in June 1933.
