Scope and Contents

Folder containing copies of orders, affidavits of service, stipulations, and other documents filed in January 1930 in the United States District Court for the Southern District of New York in Equity Case No. 20-146. The file folder has been annotated in ink with a list of documents that includes an order to show cause why the Handley Page, Limited, the Aircraft Disposal Company Limited, and William H. Workman should not be punished for contempt for violation of a perpetual injunction issued July 14, 1921. That injunction related to infringement of seven patents owned by Curtiss Aeroplane and Motor Corporation resulting from the shipment of Handley Page type 0-400 plane (marked G-AACN and HP) to William H. Workman at Mitchel Field during the month of May 1920 to compete for the Daniel Guggenheim Foundation Safe Aircraft Competition prize. The file includes depositions by Charles H. Day (with diagrams of fuel tanks and lists of parts); Frank N. Waterman; Robert R. Osborn; William E. Valk, Jr.; Arthur S. Browne (with diagrams of fuel tanks); Major James H. Cordes; Theodore P. Wright; Frank H. Russell. Exhibits in the file include photostatic copies of correspondence between Frank H. Russell, Vice President of Curtiss Aeroplane and Motor Company, and F. Handley Page in 1929 about patent infringement. There are also four photographs of the aircraft. The parties settled on January 20, 1930, with Handley Page agreeing to pay $500 for a license for patent 1,296,730 and promptly shipping the plane out of the United States. The file also includes a copy of a Final Consent Decree issued in March 1931 by the United States District Court for the Eastern District of New York inequity case No. 4608 relating to an infringement by Curtiss on Frederick Handley Page patents 1,353,666 and 1,427,012 in the construction of the Curtiss “Tanager” which took part in the Daniel Guggenheim International Safe Aircraft Competition in 1929.
